These terms apply to purchases made under the offer. The German version prevails.
The provider of the "flintery Lifetime Deal" promotion is Rafik Halabi, Esmarchstr. 5, 40223 Düsseldorf, Germany (the "Provider"). These Terms of Participation apply in addition to flintery's General Terms and Conditions. In the event of any conflict, these Terms of Participation take precedence for this promotion.
As part of the promotion, the Provider offers lifetime access to flintery Premium, limited to a one-time total of 250 places. The price is determined by a tier schedule fixed in advance; the decisive factor is the number of places already sold at the time of purchase:

Binding is the price shown in the checkout at the time the purchase is completed. Places are allocated in the order in which payments are received.
The tier schedule is fixed before the promotion begins and will not be changed during the promotion. The Provider will not subsequently increase the quota of 250 places and will not repeat the promotion. Places that become available again through reversal of a purchase may be reallocated; the quota of 250 will not be exceeded as a result.
The promotion has no fixed end date and ends once the quota is exhausted. The Provider reserves the right to end the promotion early; purchases already completed remain unaffected.
Lifetime access covers all features of the Premium plan in their respective current state, including all future features and updates allocated to the Premium plan, for the entire operating period of the service. The allocation of future features to the plans is at the Provider's discretion. The core functionality of the Premium plan as at the time of purchase will be retained. There is no entitlement to features of any future higher plans or to separately offered add-on products outside the plans. Lifetime access does not establish any entitlement to operation of the service for an unlimited period (Section 7).
The promotion is directed exclusively at businesses within the meaning of § 14 of the German Civil Code (BGB), that is, natural persons, legal entities and partnerships with legal capacity that act, at the time of purchase, in the exercise of their commercial or independent professional activity. Consumers within the meaning of § 13 BGB are excluded from participation. Before completing the purchase, the buyer expressly confirms that they are acting as a business.
A flintery account is required in order to use lifetime access; it is created automatically after purchase or, on request, linked to an existing account. Lifetime access may be purchased once per business and per account.
All prices stated in connection with the promotion are net prices in euros. Where statutory value added tax applies, it is added and shown during the checkout process. Payment is made as a one-time payment via the payment service provider Stripe. Lifetime access is activated immediately after receipt of payment.
No discounts, vouchers or promotional codes can be applied to purchases made under the promotion. This expressly includes referral and partner codes, in particular the 20 % discount for referred customers under the flintery Ambassador programme. The checkout does not provide for code entry; codes presented nonetheless will not be accepted. The credit under Section 11 is not a discount within the meaning of this Section and remains unaffected.
"Lifetime" refers to the operating period of the flintery service, not to the lifetime of the user or to an unlimited period. Should the Provider discontinue the service, it will announce the discontinuation at least six months in advance and will enable users to export their own data during that period.
Lifetime access is tied to the account and to the person. Transfer, resale or any other passing on to third parties is excluded.
The promotion is directed exclusively at businesses (Section 4). There is no statutory right of withdrawal; §§ 312 et seq. BGB, including the right of withdrawal under § 312g BGB, apply only to consumer contracts (§ 312 (1) BGB).
For purchases made under the promotion, the Provider grants a voluntary money-back guarantee of 30 days from the date of purchase. If the buyer declares in text form within this period (for example by email to hello@flintery.com) that they wish to make use of the guarantee, the Provider will refund the full purchase price; the buyer does not need to state reasons. Lifetime access ends upon the refund. Amounts already refunded under Section 11 are credited against the refund under this Section. The guarantee is a voluntary service provided by the Provider; Section 9 remains unaffected.
Buyers who have an active paid flintery subscription at the time of purchase receive a credit against the purchase price for the portion of the subscription fee already paid for the current billing period and not yet used up at the time of purchase. The credit is applied as a subsequent refund: the buyer pays the full tier price and then contacts the Provider (for example by email to hello@flintery.com); the Provider refunds the pro-rata amount. The notification must be made within 30 days of the purchase. The refund requires this notification and is limited to the amount of the purchase price; any excess will not be paid out. The subscription ends upon the refund. Without notification, the subscription ends at the end of the billing period already paid for. The credit is not a discount within the meaning of Section 6.
In all other respects, the contractual relationship under flintery's General Terms and Conditions applies to purchases made under the promotion. Should individual provisions of these Terms of Participation be invalid, the validity of the remaining provisions remains unaffected. German law applies. The place of jurisdiction for all disputes is Düsseldorf, provided that the buyer is a merchant, a legal entity under public law or a special fund under public law.
These Terms of Participation are provided in German and English. The English version is a translation for convenience. In the event of any discrepancy between the versions, the German version prevails. Legal terms referring to German statutes retain the meaning they have under German law.
